1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Is This Site AI? ("we," "us," or "our"), governing your access to and use of the website isthissiteai.com and all related services (collectively, the "Service").

By accessing or using the Service in any way, including submitting a URL for analysis, creating an account, or purchasing a subscription, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must not use the Service. If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

2. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that:

• You are at least 16 years old (or the applicable minimum age of digital consent in your jurisdiction, whichever is higher)
• You have the legal capacity to enter into a binding contract
• Your use of the Service does not violate any applicable law or regulation

If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Description of the Service

Is This Site AI? provides a URL analysis tool that uses automated detection techniques, including structural rule-based analysis and semantic analysis, to estimate how a website was built. The Service identifies likely site origin signals, including CMS platforms, site builders, AI builders, frameworks, and custom or proprietary stacks.

The Service is available in the following tiers:

We reserve the right to modify, limit, or discontinue any feature or tier at any time, with reasonable notice where practicable.

4. Important Limitations of Analysis Results

By using the Service, you acknowledge and accept that:

• Analysis results reflect the state of the submitted URL at the time of the scan and may not reflect subsequent changes
• Cached results (served within 24 hours of a prior scan) may not reflect the current state of the site
• The Service analyses publicly accessible content of the submitted URL only; it has no visibility into a site's development history, source code repository, or internal tooling
• We make no warranty that any result is accurate, complete, or fit for any particular purpose
• A result does not constitute a statement about the reputation, integrity, or practices of any individual or organisation

5. Web Crawling and Third-Party Sites

5.1 What We Fetch and How

When you submit a URL for analysis, our Service automatically retrieves content from that URL using standard HTTP requests, in a manner similar to a search engine crawler or web browser. Specifically, the Service may:

• Fetch the rendered HTML and CSS of the submitted URL and selected sub-pages (such as /about, /about-us, /blog)
• Follow links to same-origin pages for additional signal coverage
• Retrieve the site's favicon and linked stylesheet files
• Send scraped page content to third-party AI services (Anthropic Claude) for semantic analysis

All fetched content is processed transiently for analysis purposes only. We do not permanently store, reproduce, publish, or redistribute the content of third-party websites beyond what is technically necessary to produce and cache the analysis result. Cached analysis results store our derived scores and signals, not the raw content of the analysed site.

5.2 Public Content Only

5.3 Robots.txt and Crawl Directives

We respect the spirit of the Robots Exclusion Standard. Our crawler identifies itself and is designed to behave as a good-faith web agent. If a site operator wishes to prevent their site from being analysed by our Service, they may:

• Add our crawler user-agent to their robots.txt disallow rules
• Contact us at the address in Section 16 to request addition to our blocklist

We will honour verified opt-out requests within a reasonable time. Note that analysis results already cached before an opt-out request may remain cached until their natural expiry (24 hours).

5.4 Copyright and Scraped Content

Third-party website content fetched by the Service may be protected by copyright. Our processing of that content constitutes:

• Transient, automated, technical processing for the sole purpose of generating a derived analysis result
• Commentary on publicly observable technical characteristics, not reproduction or distribution of the original work
• Processing that is proportionate and limited to what is necessary for the analysis purpose

We rely on the fair use doctrine (US), the text and data mining exception (EU Directive on Copyright in the Digital Single Market, Article 4), and equivalent provisions under Estonian copyright law (Autoriõiguse seadus) as the legal basis for our automated content processing. We do not claim ownership of any third-party content and do not use it for any purpose other than producing the analysis result.

5.5 No Liability for Submitted URLs

You are solely responsible for the URLs you submit for analysis. By submitting a URL, you represent that:

• You have a legitimate purpose for submitting that URL for automated analysis
• You are not submitting URLs with the intent to probe, attack, or cause harm to the target site or its infrastructure
• You understand that the Service is a passive analysis tool and that we are not responsible for any third-party terms of service that may apply to automated access of the submitted URL

We are not responsible for any claim by a third-party site owner arising from your decision to submit their URL for analysis. If you are concerned about whether automated analysis of a particular URL is permissible, you should seek independent legal advice before submitting it.

5.6 DMCA and Copyright Takedown

If you are a copyright owner and believe that content on our Service infringes your copyright, you may submit a takedown notice to our designated agent. A valid notice must include:

• Identification of the copyrighted work you claim has been infringed
• Identification of the specific material you claim is infringing and its location on our Service
• Your contact information (name, address, telephone, email)
• A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf
• Your electronic or physical signature

We will respond to valid notices promptly and take appropriate action, which may include removing or disabling access to the identified material. Note that analysis results consist of derived scores and signals, not reproduced third-party content; most takedown requests relating to analysis results will therefore not be actionable under copyright law.

6. User Accounts

6.1 Registration

You may use certain features of the Service without registering. To access higher usage limits and Pro features, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password confidential and not share it with any third party
• Notify us immediately at [email protected] if you suspect any unauthorised use of your account

You are responsible for all activity that occurs under your account.

6.2 One Account per User

Each person may maintain only one registered account. Creating multiple accounts to circumvent usage limits or any suspension is a material breach of these Terms and grounds for immediate termination of all associated accounts.

6.3 Account Security

We implement reasonable security measures, including Supabase authentication, secure session cookies, and client-side login-attempt throttling. However, you are responsible for maintaining the security of your own credentials. We are not liable for loss or damage arising from your failure to protect your account credentials.

7. Subscriptions and Billing

7.1 Pro Subscription

Access to Pro features requires a paid subscription processed through Stripe. By purchasing a Pro subscription, you agree to:

• Pay the applicable subscription fee in advance for each billing period
• Provide accurate and complete billing information
• Authorise us (via Stripe) to charge your payment method on a recurring basis

7.2 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can manage or cancel your subscription at any time through the billing portal accessible from your account dashboard.

7.3 Refunds

We offer refunds at our discretion. Given the nature of the Service, which delivers immediate digital results, we generally do not provide refunds for subscription periods already consumed.

EU/EEA consumers: If you are a consumer in the EU or EEA and you have not yet used any Pro scans under your current subscription period, you may request a full refund within 14 days of purchase under the EU right of withdrawal (Directive 2011/83/EU). This right does not apply once you have actively used the Pro service (e.g., performed a scan). To exercise this right, contact us at [email protected] within 14 days of the charge, stating that you wish to withdraw from the contract. We will process your refund within 14 days of receiving your request.

If you believe you are entitled to a refund on other grounds, please contact us within 14 days of the charge and we will assess your request.

7.4 Price Changes

We may change subscription prices. We will give you at least 30 days’ written notice before any price change takes effect. Continuing to use the Service after a price change constitutes acceptance of the new price. If you do not accept the new price, you may cancel your subscription before the change takes effect.

7.5 Taxes and VAT

For EU consumers, displayed prices will include VAT where required by applicable EU law. You are responsible for any taxes applicable to your use of the Service under the laws of your jurisdiction beyond what is displayed.

8. Acceptable Use

8.1 Permitted Uses

You may use the Service to:

• Analyse publicly accessible websites for your own personal or business research
• Share individual analysis results for non-commercial informational purposes
• Integrate Pro-tier results into your own internal workflows

8.2 Prohibited Conduct

You must not:

• Scrape, crawl, or systematically extract analysis results or any other data from the Service by automated means
• Resell, sublicense, or commercially redistribute analysis results or API access without our prior written consent
• Use the Service to build, train, or improve a competing product or service that detects website build origin
• Circumvent, disable, or interfere with any rate limiting, quota enforcement, CSRF protection, or other security mechanism
• Submit URLs for the purpose of probing, testing, or attacking the internal infrastructure of any target (SSRF abuse)
• Submit URLs that you do not have a legitimate purpose to analyse
• Create multiple accounts to circumvent usage limits
• Use analysis verdicts to make defamatory, harassing, or unfounded reputational claims about third parties
• Use the Service in any way that violates applicable law, including EU consumer protection law, competition law, or GDPR
• Attempt to reverse-engineer the scoring model, signal weights, or detection logic

9. Intellectual Property

9.1 Our Property

The Service, including its software, scoring algorithms, detection rule engine, signal definitions, UI, and all related technology, is owned by us and protected by applicable intellectual property laws, including Estonian copyright law and EU Directive 2009/24/EC on the legal protection of computer programs. These Terms do not grant you any ownership interest in the Service.

9.2 Analysis Results

Individual analysis results generated for URLs you submit are provided to you for your personal or internal business use. You may share individual results for non-commercial, informational purposes (e.g., posting a screenshot or sharing a link), provided you do not misrepresent the nature or reliability of the result. You may not aggregate, systematically collect, or commercially exploit the results.

9.3 Nature of Verdicts: No Defamatory Intent

Analysis results produced by the Service are automated, algorithmic outputs based on observable technical characteristics of publicly accessible web content. They are not editorial statements, opinions, or reviews. Specifically:

• A result identifying a particular platform or builder does not constitute an allegation of deception, fraud, dishonesty, or any wrongdoing by the site owner or developer
• A result indicating a custom or proprietary stack does not constitute an endorsement, certification, or guarantee of the site's quality or origin
• Results reflect technical signal detection at a point in time, not a judgment about any person's character, competence, or business practices
• We expressly disclaim any intent to defame, disparage, or harm the reputation of any site owner, developer, or organisation

If you use a result to make a public claim about a third party in a manner that could be considered defamatory or harmful, you do so entirely at your own risk and liability. We accept no responsibility for how users choose to communicate or act upon analysis results.

9.4 Third-Party Content

The Service analyses third-party websites. We do not claim ownership of any content on those websites. Our analysis constitutes commentary on publicly observable technical characteristics and does not constitute reproduction, endorsement, or editorial characterisation of third-party content or its creators.

9.5 Feedback

If you submit feedback, suggestions, or ideas about the Service, you grant us a perpetual, royalty-free, worldwide licence to use that feedback for any purpose without compensation to you.

10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, error-free, or available at any particular time
• Analysis results will be accurate, complete, or current
• The Service will detect all website builders or custom stacks, or that any specific result is correct
• The Service will meet your specific requirements

Nothing in these Terms limits any rights you may have as a consumer under mandatory EU consumer protection legislation or Estonian law that cannot be excluded by contract.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• We will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, loss of goodwill, or reputational harm, arising out of or in connection with your use of the Service or any analysis result
• Our total aggregate liability to you for any claims arising under or in connection with these Terms will not exceed the greater of (a) the total fees you paid to us in the 12 months preceding the claim, or (b) €50
• We are not liable for any action you take (or fail to take) in reliance on an analysis result, including any legal, commercial, employment, or reputational decision
• We are not liable for any claim brought by a third-party site owner arising from your decision to submit their URL for analysis

These limitations apply regardless of the legal theory under which the claim arises (contract, tort, statute, or otherwise) and even if we have been advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability that cannot be excluded under mandatory EU law or Estonian law, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

12. Indemnification

You agree to indemnify, defend, and hold harmless Is This Site AI?, its officers, employees, contractors, and agents from and against any claims, damages, costs, and expenses (including reasonable legal fees) arising from or relating to:

• Your violation of these Terms
• Your use of the Service in a manner not permitted by these Terms
• Any claim by a third-party site owner arising from your submission of their URL for analysis
• Any claim by a third party arising from how you communicated, shared, or acted upon an analysis result (including defamation claims)
• Your violation of any applicable law

13. Termination and Suspension

13.1 Termination by You

You may stop using the Service and delete your account at any time. Cancellation of a paid subscription takes effect at the end of the current billing period; you will retain Pro access until then.

13.2 Termination or Suspension by Us

We may suspend or permanently terminate your access to the Service at our discretion, immediately and without prior notice, if we reasonably believe that you have:

• Violated any provision of these Terms, including the Acceptable Use policy in Section 8
• Created multiple accounts to circumvent limits or evade a prior suspension
• Used the Service in a manner that poses a risk to the Service, other users, or third parties
• Engaged in fraudulent, abusive, or illegal conduct

We may also suspend or discontinue the Service in whole or in part for operational, technical, or legal reasons, with reasonable notice where practicable.

13.3 Effect of Termination

Upon termination:

• Your right to access the Service ceases immediately
• Any Pro subscription is cancelled (with no refund for the unused portion, unless required by law)
• We may retain your data for the periods described in our Privacy Policy, including for legal compliance and fraud prevention purposes
• Sections 4, 5, 9, 10, 11, 12, 14, and 15 survive termination

13.4 Scan History on Downgrade

If your Pro subscription expires or is cancelled and your account reverts to the Free tier, your existing scan history records are retained in our database in accordance with our Privacy Policy retention schedule. However, access to your scan history through the product interface is a Pro feature; downgraded accounts will not be able to view historical scans until a Pro subscription is reinstated.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Estonia and, where applicable, the laws of the European Union, without regard to conflict-of-law principles.

If you are a consumer resident in an EU member state, you also benefit from any mandatory consumer protection provisions of the law of your country of residence that cannot be derogated from by contract.

14.2 Jurisdiction

For non-consumer users, any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of Estonia (Harju County Court as the court of first instance).

For consumer users in Estonia, disputes may be submitted to the Consumer Disputes Committee (Tarbijavaidluste komisjon) at tarbijakaitseamet.ee. This does not affect your right to bring proceedings before the courts.

14.3 EU Online Dispute Resolution

The European Commission's Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025. EU consumers can instead use the list of approved Alternative Dispute Resolution (ADR) bodies at https://consumer-redress.ec.europa.eu/list-alternative-dispute-resolution-adr-bodies_en. 14.4 Informal Resolution

Before initiating any formal proceedings, we encourage you to contact us at [email protected]. We will try to respond within 15 business days and resolve disputes informally wherever possible.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this document
• Post the revised Terms on this page
• Notify registered users by email or prominent in-app notice at least 30 days before the changes take effect

If you are a registered user and do not accept the updated Terms, you may terminate your account before the effective date. Continuing to use the Service after the effective date constitutes acceptance of the updated Terms. For anonymous users, continued use constitutes acceptance.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Service and supersede all prior agreements, representations, or understandings.

16.2 Severability

If any provision of these Terms is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision will not be considered a waiver of that right. Any waiver must be in writing to be effective.

16.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of substantially all of our assets, with notice to you.

16.5 Force Majeure

We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including internet outages, hosting infrastructure failures, third-party service failures (including but not limited to the unavailability of AI or LLM providers such as Anthropic Claude, web scraping services, or any other third-party API on which the Service depends), natural disasters, epidemics, pandemics, or acts of government or regulatory authority.

16.6 Language

These Terms are provided in English. If we provide a translation and there is a conflict, the English version prevails, except where mandatory local law requires otherwise.

16.7 Accessibility

We are committed to making the Service accessible to as wide an audience as possible. We aim to conform to the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA where reasonably practicable, in line with the European Accessibility Act (Directive (EU) 2019/882), which applies from 28 June 2025.
